SHIH TZU JUNCTION
PROFESSIONAL PUPPY PURCHASE AGREEMENT
HEALTH RECORD AND DISCLOSURE
The Breeder certifies that, to the best of their knowledge, the puppy is in good general health at the time of transfer. The Buyer acknowledges receipt of all available veterinary records, vaccination records, deworming records, and any additional health documentation relating to the puppy.
The Buyer understands that minor conditions common in young puppies, including but not limited to stress-related diarrhea, adjustment-related appetite changes, tear staining, and mild environmental sensitivities, may occur during the transition to a new home and shall not be considered grounds for return, replacement, or refund.
VACCINATION AND PREVENTATIVE CARE
The puppy has received age-appropriate vaccinations, deworming treatments, and preventative veterinary care while in the Breeder's possession.
The Buyer agrees to continue all vaccinations, boosters, heartworm prevention, flea and tick prevention, and routine veterinary examinations as recommended by a licensed veterinarian.
Failure to maintain appropriate veterinary care may result in the voiding of any health guarantees provided under this agreement.
The Buyer acknowledges that over-vaccination, delayed vaccination schedules, or failure to follow veterinary recommendations may negatively affect the health of the dog and shall not be the responsibility of the Breeder.
BUYER INITIALS: _______
VETERINARY EXAMINATION REQUIREMENT
The Buyer agrees to have the puppy examined by a licensed veterinarian within seventy-two (72) hours of receiving possession of the puppy.
If a serious health condition is identified during this examination, the Buyer must notify the Breeder immediately and provide a written veterinary report.
Failure to obtain the required examination within seventy-two (72) hours shall render all health guarantees contained within this agreement null and void.
BREEDER RIGHT TO REFUSE PLACEMENT AND CANCEL AGREEMENT
The Buyer acknowledges that the health, safety, and long-term welfare of the puppy are the Breeder's highest priorities.
The Breeder reserves the absolute right to refuse placement of the puppy and terminate this Agreement at any time prior to the physical transfer of the puppy if information becomes known that causes the Breeder to reasonably believe the Buyer may be unable or unwilling to provide appropriate care, supervision, housing, veterinary treatment, training, socialization, financial support, or a safe and suitable environment for the puppy.
Such information may include, but is not limited to:
• Misrepresentation or omission of material facts during the application or screening process. • Evidence of neglect, abuse, abandonment, or improper care of animals. • Unsafe living conditions. • Housing restrictions that prohibit pet ownership. • Financial circumstances that may prevent adequate care of the puppy. • Failure to maintain communication with the Breeder. • Aggressive, threatening, abusive, or inappropriate behavior toward the Breeder. • Any circumstance that, in the Breeder's sole judgment, may negatively affect the welfare or quality of life of the puppy.
If the Breeder exercises the right to cancel the placement prior to transfer, the Breeder may, at the Breeder's sole discretion:
(a) Refund all monies paid by the Buyer; or
(b) Refund all monies paid less any non-recoverable expenses incurred by the Breeder specifically for the care, transportation, veterinary treatment, registration, or preparation of the puppy.
The Breeder's decision to refuse placement shall be final and shall not constitute a breach of contract.
The Buyer acknowledges that no ownership rights are transferred until the puppy has been physically delivered to and accepted by the Buyer. Until such transfer occurs, the puppy shall remain the sole property of the Breeder.
The parties agree that the Breeder's exercise of this provision is intended solely to protect the welfare and best interests of the puppy.
HEALTH GUARANTEE
The Breeder guarantees that the puppy is free from life-threatening congenital and hereditary defects for a period of one (1) year from the date of transfer.
Should a licensed veterinarian diagnose a life-threatening hereditary or congenital defect during the guarantee period, the Buyer must provide complete veterinary documentation to the Breeder within seven (7) business days of diagnosis.
The Breeder reserves the right to obtain a second veterinary opinion from a veterinarian of the Breeder's choosing.
If the diagnosis is confirmed, the Breeder's sole obligation shall be the provision of a replacement puppy of equal or lesser value when one becomes available.
No cash refunds, reimbursement of veterinary expenses, transportation expenses, emotional damages, lost wages, or other costs shall be provided.
The replacement guarantee shall be the exclusive remedy available to the Buyer.
To qualify for a replacement puppy, the original dog must be returned to the Breeder unless otherwise agreed in writing.
CONDITIONS EXCLUDED FROM GUARANTEE
The health guarantee specifically excludes, but is not limited to:
• Parasites • Giardia • Coccidia • Kennel cough • Hypoglycemia • Allergies • Viral or bacterial infections acquired after transfer • Injuries • Accidents • Obesity-related conditions • Dental alignment issues • Umbilical hernias • Stenotic nares • Underbite or overshot bite conditions • Luxating patellas diagnosed after transfer unless proven hereditary by a veterinary specialist • Conditions resulting from neglect, abuse, improper nutrition, inadequate veterinary care, or environmental factors
MICROCHIP AGREEMENT
The puppy will be microchipped prior to transfer.
The Breeder shall enroll the puppy in AKC Reunite lifetime registration. The Breeder shall remain listed as the primary contact and the Buyer shall remain listed as the secondary contact.
The Buyer agrees not to remove or alter the microchip and agrees to notify the Breeder immediately if ownership information changes.
If the dog becomes lost, surrendered, abandoned, or impounded, the Buyer authorizes the Breeder to assist in recovery efforts.
SPAY AND NEUTER AGREEMENT
Unless full breeding rights are specifically granted in writing, this puppy is sold strictly as a companion animal.
The Buyer agrees to spay or neuter the dog at an age recommended by their veterinarian.
Proof of spay or neuter must be provided to the Breeder within thirty (30) days of the procedure.
Failure to comply with this provision constitutes a material breach of this agreement.
BREEDING RESTRICTIONS
No breeding rights are conveyed under this agreement unless specifically granted in writing.
Any unauthorized breeding, intentional or accidental, shall result in liquidated damages in the amount of Five Thousand Dollars ($5,000.00) per litter.
The Buyer acknowledges that this amount is reasonable and intended to compensate the Breeder for damages associated with unauthorized breeding and loss of breeding program integrity.
LIFETIME RETURN POLICY
If at any time during the dog's life the Buyer is unable or unwilling to keep the dog, the Buyer agrees to immediately notify the Breeder.
The dog may not be surrendered to a shelter, rescue organization, pet store, research facility, or any third party without first providing the Breeder the opportunity to reclaim or assist in rehoming the dog.
The Breeder reserves the right of first refusal regarding placement of the dog.
PHOTO AND MARKETING RELEASE
The Buyer grants permission to the Breeder to use photographs, videos, and likenesses of the puppy for educational, promotional, advertising, website, and social media purposes.
No personal identifying information of the Buyer shall be published without written consent.
LIMITATION OF LIABILITY
The Buyer understands that ownership of a dog carries inherent risks.
The breeder shall not be held liable for injuries, damages, losses, expenses, or claims arising from the actions, behavior, or ownership of the dog after transfer.
The Buyer assumes full responsibility for the care, supervision, training, and control of the dog upon transfer.
DEFAULT AND ATTORNEY FEES
Should either party bring legal action to enforce this agreement, the prevailing party shall be entitled to recover reasonable attorney fees, court costs, and related legal expenses.
GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of the State in which the Breeder resides.
SEVERABILITY
If any provision of this agreement is found unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
BUYER COMMUNICATION AND BLACKOUT CLAUSE
The Buyer agrees to maintain current and accurate contact information with the Breeder, including telephone number, mailing address, and email address, for the lifetime of the dog.
The Buyer agrees to respond to reasonable communications from the Breeder regarding matters related to the dog's health, welfare, registration, microchip information, contractual obligations, or rehoming concerns.
If the Buyer becomes unreachable or fails to respond to written communications regarding a material obligation under this Agreement for a period exceeding thirty (30) consecutive days ("Communication Blackout"), the Breeder may suspend any pending contractual benefits, including but not limited to registration paperwork, replacement puppy rights, health guarantee claims, breeder support services, and other obligations until communication is reestablished.
If the Communication Blackout prevents the Breeder from verifying compliance with spay/neuter requirements, microchip registration requirements, breeding restrictions, or the dog's welfare, the Buyer may be deemed in breach of this Agreement.
In circumstances where the Breeder reasonably believes the dog's welfare is at risk and the Buyer cannot be contacted despite reasonable efforts, the Breeder reserves the right to contact veterinarians, animal control authorities, microchip registries, shelters, rescues, or other relevant parties for the sole purpose of verifying the dog's safety and well-being.
A Communication Blackout shall not relieve the Buyer of any obligations under this Agreement.
ENTIRE AGREEMENT
This document constitutes the entire agreement between the parties and supersedes all prior verbal or written discussions, representations, or agreements.
No modification of this agreement shall be valid unless made in writing and signed by both parties.
DEPOSIT POLICY
A non-refundable reservation deposit of Six Hundred Dollars ($600.00) is required to reserve the puppy described in this agreement.
The Buyer understands and agrees that the Breeder removes the puppy from active marketing and may decline other qualified buyers once a deposit is received. Therefore, all deposits are non-refundable except in the event of the puppy's death, serious illness, or the Breeder's inability to provide the puppy as agreed.
The deposit may not be transferred to another person or puppy, without the Breeder's written consent.
PAYMENT TERMS
The total purchase price of the puppy is $2600.
The non-refundable deposit of $600, shall be credited toward the purchase price, leaving a remaining balance of $ 2000.
For puppies purchased through Good Dog, the remaining balance must be paid no later than seventy-two (72) hours prior to pickup.
For direct purchases, the remaining balance shall be paid in cash at the time of pickup unless otherwise agreed in writing.
The Breeder reserves the right to withhold possession of the puppy until all funds have cleared.
NO REFUND POLICY
The Buyer understands that purchasing a puppy is a long-term commitment.
Except as specifically stated within the Health Guarantee section of this agreement, all payments made to the Breeder are non-refundable.
The Buyer's inability to keep, train, house, transport, or care for the puppy shall not constitute grounds for a refund.
PICKUP DEADLINE
The Buyer agrees to take possession of the puppy on the mutually agreed pickup date.
Unless otherwise agreed in writing, puppies not picked up within seven (7) days of the agreed pickup date may be considered abandoned.
In such cases, the breeder reserves the right to retain all monies paid and may place the puppy in another approved home without further obligation to the Buyer.
BUYER RESPONSIBILITIES
The Buyer agrees to:
• Provide proper nutrition and fresh water daily. • Maintain routine veterinary care. • Provide vaccinations and parasite prevention. • Provide proper grooming for the breed. • Provide adequate training and socialization. • Maintain a safe and secure environment. • Comply with all applicable local and state animal ownership laws.
The Buyer acknowledges that failure to meet these responsibilities may negatively affect the health and temperament of the dog and may void any applicable guarantees.
TEMPERAMENT DISCLAIMER
The Breeder has carefully evaluated the puppy and made every effort to produce sound temperament through responsible breeding, early neurological stimulation, and socialization.
However, because temperament is influenced by genetics, environment, training, socialization, and owner management, the Breeder cannot guarantee future behavior, personality traits, size, color, coat quality, breeding potential, show quality, or adult weight.
REGISTRATION PAPERS
Any registration papers provided by the Breeder shall remain the property of the Breeder until all contractual obligations have been fulfilled.
For puppies sold with limited registration, proof of spay or neuter must be provided before registration documents are released.
The Breeder reserves the right to delay or withhold registration paperwork if the Buyer is in breach of any provision of this agreement.
CHARGEBACK AND PAYMENT DISPUTE CLAUSE
The Buyer agrees that initiating a chargeback, payment dispute, or reversal of funds without first providing written notice to the Breeder and an opportunity to resolve the matter shall constitute a breach of this agreement.
In the event of an improper chargeback or payment dispute, the Buyer shall be responsible for all collection costs, court costs, attorney fees, and expenses incurred by the Breeder in recovering funds owed.
TRANSFER OF OWNERSHIP
Ownership and responsibility for the puppy transfer to the Buyer immediately upon physical possession of the puppy or delivery to a transportation provider designated by the Buyer.
Upon transfer, the Buyer assumes all responsibility for the care, safety, health, training, supervision, and actions of the dog.
SHIPPING AND TRANSPORT
If transportation is arranged by the Buyer, all transportation expenses shall be the responsibility of the Buyer.
The Breeder is not responsible for delays, injuries, illnesses, accidents, or losses occurring during transportation once the puppy has been released to the carrier.
RIGHT OF REPOSSESSION
If the Breeder reasonably believes the dog is being neglected, abused, abandoned, used for unlawful purposes, or maintained in conditions that endanger the dog's welfare, the Breeder reserves the right to seek legal recovery of the dog.
The Buyer agrees to cooperate with any court-ordered recovery efforts.
ATTORNEY FEES AND COLLECTION COSTS
In any action brought to enforce this agreement, the prevailing party shall be entitled to recover reasonable attorney fees, court costs, collection costs, expert witness fees, and other related expenses.
